WHY DO YOU NEED A LAWYER?

You need a lawyer or professional advocate if your Social Security disability claim was denied.  There are many reasons.

1.  You probably don't know anything about medical-vocational guidelines, listings, date last insured or how medical evidence is evaluated.  A professional who earns his/her living with disability appeals will know all of this.

2.  You won't know anything about the judge who will preside over your case and make the decision at your hearing.  A professional who practices in this field will know the judge and how he or she conducts a hearing.

3.  You certainly want the maximum benefits, including all the back pay to which you are entitled.  Your attorney/advocate will get you as much back pay as possible and will protect other valuable rights during the appeal.

4.  Everyone else taking part in your hearing will be a paid professional.  This includes the judge, the vocational witness and medical witnesses, if any.  They have attended thousands of hearings.  This is your first hearing, so don't be the guinea pig.  Bring in a pro.

The next question is, when should you bring in an attorney or expert?  The answer is, as soon as possible.  Attorneys don't get paid by the hour on these type cases, so waiting until the last minute doesn't save you any money.  Your representative will be paid a percentage of back pay recovered, so the fee will be the same regardless of how long he/she worked on the case.  Bringing an attorney/advocate onboard at the last minute puts you at a disadvantage and doesn't allow adequate time to prepare the case.

When choosing a representative, look for one who has extensive experience in Social Security disability.  You wouldn't go to a dermatologist for treatment of a heart condition.  So, don't go to a car accident lawyer for your Social Security claim.
